Right to compensation lapses after 12 months of accident. Section 27 of the Work Injury Benefits Act provides that the lapse of the right to benefit occurs when the accident is not reported to the employer within 12 months after date of such accident. Imara Steel Mills Ltd v Heritage Insurance Co. Kenya Ltd & 38 others [2016] eKLR Section 22 (5) and 27 of the Work Injury Benefits Act establishes a statutory right on notification and lapse of claims. The provisions set an upper time limit of twelve months but with a proviso that an employee is not precluded from reporting an accident or injury at any stage.
