Right to take disciplinary measures against employees.

An employer has the right to take disciplinary measures against employees. Under Common Law, Employer’s disciplinary action is a response by the employer to problems with employee performance or behavior. It may come in the form of a verbal or written reprimand or the loss of employee privileges. The purpose of disciplinary action is to correct behavior and document issues. In Fredrick Saundu Amolo v Principal Namanga Mixed Day Secondary School & 2 others [2014] eKLR the court noted that where there are legitimate reasons for an employer to commence the process of suspension or interdiction, the court will not interfere with the same but the process must conform to both procedural and substantive fairness.
